Mold Dog USA - Terms and Conditions
1. Scope of Services:

Mold Dog USA provides K9 mold detection services. Our trained dogs and handlers will conduct a visual and olfactory inspection of the property to identify potential mold presence.

This inspection is a non-invasive assessment. We do not perform any invasive testing, such as wall demolition or sample collection.

The K9 inspection is one tool to use in an overall mold investigation, and is not the only tool that should be used.

We do not write protocol for remediation.
2. Limitations and Disclaimer:

No Guarantees: Mold Dog USA does not guarantee the complete absence of mold or the accuracy of the dog's findings. K9 detection is a highly effective tool, but it is not infallible.

No Liability for Remediation: Mold Dog USA is not responsible for any remediation, remodeling, demolition, or other related costs incurred as a result of our inspection. Any remediation decisions are solely the responsibility of the client.

Third-Party Testing: Mold Dog USA recommends that clients consider independent third-party testing to confirm the presence and type of mold identified by our K9 inspection.

Odor Availability: Client acknowledges that the K9 can only detect mold odor if it is actively available. Mold odor may be contained within walls, under flooring, or in other concealed areas, and may not always be detectable. Additionally, mold odors located at heights exceeding approximately 10 feet, such as in high ceilings (e.g., 18-foot ceilings), are generally beyond the detection range of the K9.

Property Damage: Client acknowledges that Mold Dog USA is not responsible for potential property damage caused by the K9 during the inspection, including but not limited to scratched cabinets, knocked-over lamps, or other incidental damage.

Video Usage: Client acknowledges that if video is taken or used by Mold Dog USA, the client will not receive any compensation for the video performance. These videos are for educational purposes only.
3. Client Responsibilities:

Pet Control: All pets and animals must be securely confined or removed from the premises prior to and during the inspection. Failure to comply will result in the cancellation of the appointment, and any deposits will be retained.

Access: Client must provide clear and unobstructed access to all areas of the property to be inspected.

Safety: Client is responsible for ensuring the safety of the handler and dog on the property. Any known hazards must be disclosed prior to the appointment.
4. Deposits and Cancellations: Mold Dog USA Driving To Client

If driving to clients home- A non-refundable deposit of $250 is required to secure the appointment.

In the event of a cancellation, the $250 deposit will be retained by Mold Dog USA. The client may apply this deposit towards a future booking, provided the new booking is scheduled within three (3) months of the original cancellation date.

Cancellations made less than 48 hours prior to the appointment will result in the forfeiture of the deposit and the client will not be able to use it for future bookings.

Mold Dog USA reserves the right to reschedule or cancel appointments due to unforeseen circumstances.
Non-Refundable Nature (Partial Refund): Mold Dog USA Flying to Client

A non-refundable deposit of 50% of the total estimated service fee is required to secure your appointment and initiate the scheduling process.

The deposit serves as confirmation of your commitment to the scheduled service and covers initial expenses related to travel and preparation.

While the initial deposit is non-refundable, in the event of cancellation by the client, a partial refund may be issued, less any direct expenses already incurred by Mold Dog USA.

Direct expenses include, but are not limited to:

Fuel costs for the trip.
-
Mileage costs $2 per mile.
-
Any overnight accommodation costs already paid (if applicable).
-
Any non-refundable travel related costs.

Cancellations made less than 48 hours prior to the appointment will result in the forfeiture of the deposit and the client will not be able to use it for future bookings.

Mold Dog USA reserves the right to reschedule or cancel appointments due to unforeseen circumstances.
5. Confidentiality:

Mold Dog USA will keep client information confidential.

Client agrees that Mold Dog USA can use photos and videos of the dog working, but will not disclose the location of the home, or the clients personal information.
6. Indemnification:

Client agrees to indemnify and hold Mold Dog USA, its officers, employees, and agents harmless from any and all claims, liabilities, damages, and expenses (including reasonable attorney's fees) arising out of or related to Client's breach of this agreement or any negligent acts or omissions.
7. Limitation of Liability:

In no event shall Mold Dog USA's liability exceed the amount paid by Client for the services provided under this agreement.
8. Dispute Resolution:

Any disputes arising out of or related to this agreement shall first be submitted to non-binding mediation. If mediation is unsuccessful, disputes shall be resolved through binding arbitration in accordance with the rules of [Arbitration Organization].
9. Weather or Unforeseen Delays:

Mold Dog USA reserves the right to reschedule or cancel appointments due to inclement weather, hazardous conditions, or other unforeseen circumstances that may affect the safety or effectiveness of the inspection.
10. Photos and Videos:

All photos and videos taken during the inspection are the sole property of Mold Dog USA. Mold Dog USA reserves the right to use these materials for marketing, training, or other business purposes.
11. Entire Agreement:

This agreement constitutes the entire agreement between Mold Dog USA and the client.
12. Severability and Waiver:

If any provision of this agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The failure of either party to enforce any provision of this agreement shall not constitute a waiver of that provision or any other provision.
13. Force Majeure:

Mold Dog USA shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, and government regulations.
14. Definitions:

"K9": Refers to the trained canine used for mold detection.

"Client": Refers to the individual or entity contracting Mold Dog USA's services.
-
"Inspection": Refers to the K9 mold detection service provided by Mold Dog USA.
-
"Odor": Refers to the scent produced by mold that the K9 is trained to detect.
Compliant Statement Privacy Policy.
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
